RIDER RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFICATION AGREEMENT

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS LEGAL RIGHTS.

In consideration for being allowed to participate in Circumnavilake and related activities (the “Event”), I agree as follows:

1. Voluntary participation and fitness.  I choose to participate voluntarily. I represent that I am physically able, adequately trained, and equipped for the Event. I will not participate while impaired or when a medical condition makes participation unsafe.

2. Rules and safety.    I will wear a properly fitted bicycle helmet while riding, obey traffic laws and Event instructions, ride predictably, yield when required, and use equipment in safe working condition. I understand roads and trails may remain open to vehicles, pedestrians, animals, and other users. Event personnel may remove me from the Event if they reasonably believe continued participation is unsafe.

3. Assumption of risk.  Cycling and Event activities involve inherent and other risks, known and unknown, including collision with vehicles, bicycles, people, animals, or objects; falls; road or trail defects; weather; limited visibility; equipment failure; fatigue; dehydration; getting lost; delayed medical care; and the acts or omissions of participants or third parties. These risks may cause property damage, serious injury, permanent disability, paralysis, or death. I knowingly and voluntarily assume all such risks,

4. Release to the extent permitted by Louisiana law. To the fullest extent permitted by Louisiana law, I release and agree not to sue Circumnavilake, route or site owners, municipalities, volunteers, officers, directors, employees, contractors, agents, and their respective successors and assigns for claims involving loss of or damage to my bicycle, equipment, or other personal property arising from my participation in or travel to and from the Event. Nothing in this agreement is intended to exclude or limit liability for physical injury, intentional or gross fault, or any other liability that cannot lawfully be excluded or limited under Louisiana law.

5. Responsibility for participant’s conduct. I am responsible for losses, damages, or claims caused by my own unlawful, reckless, or intentional conduct during the Event. To the extent permitted by Louisiana law, I agree to reimburse the Released Parties for reasonable costs resulting directly from such conduct. This provision does not require me to indemnify any person for that person’s own fault where prohibited by law.

6. Medical care.  If I am unable to consent, I authorize Event personnel to seek emergency medical care they reasonably consider necessary. I understand the Event does not guarantee medical support and I am responsible for medical and transportation costs not

otherwise covered.

7. Personal property and insurance.  I am responsible for my bicycle, equipment, and personal property. I understand the organizer does not provide health, accident, disability, or property insurance for me unless stated in writing.

8. Governing law; severability.  This agreement will be governed by the laws of the State of Louisiana. Any unenforceable provision will be modified only as needed or severed, and the remainder will continue in effect. Venue for any permitted dispute will be in Orleans Parish, Louisiana, unless applicable law requires otherwise.

ACKNOWLEDGMENT: I have read this entire agreement, understand the risks and responsibilities described above, have had the opportunity to ask questions, and sign voluntarily. I understand that this agreement affects legal rights but does not waive rights that cannot lawfully be waived under Louisiana law.
